Ronald Earle, District Attorney

509 W.11th St Austin, TX 78701

Dear Sir;

My neighbor has started building a single-family resident on Storm Road here in Travis County.

I ask for open records on his permit.   When I received copies of his permit it was clear to see, that he was building a commercial property on land deem by deed restrictions as property to be used for single-family dwellings only.

I wrote him a letter explaining that commercial properties are against the restrictions. Also pointing out that falsifying a document to Travis County is against the law.

He wrote back that this was okay because it would be used for personal use only.   So, he did not have to abide by the restrictions and it was not illegal to list his property as a single family dwelling when in reality it is a commercial site.

Since you or the legal authority can you please tell me what the is truth here?

Can anyone falsify an application for a building permit with Transportation and Natural Resources of Travis County?

Please see the attached exhibits as proof of what I have stated.

Exhibit A: His documents submitted for a permit to build a single-family dwelling.
Basic Development Permit #06-0684 2-2-2006

Exhibit B: His plans submitted for a commercial building.

Exhibit C: On-Site Wastewater #2006-05-0063

Exhibit D: The Property Restrictions 28-0130 units 5 and 11 thou 16

I am looking forward to your answer and hope that you can clarify the situation.  What is happening is my neighborhood in Travis County has quickly started turning from residential property to commercial by simply saying this is for personal use, since we have no homeowners association to enforce the deed restrictions.  These builders think that they can get away with anything because the deed restrictions are unenforceable.  They simply put down for the least expensive permit and then do wantever they want with no regard to the consequences.

Sincerely Yours,

David P. Griffin
